De Nederlandse versie van deze voorwaarden is juridisch leidend.

2. Toepasselijkheid / Applicability
Deze algemene voorwaarden zijn van toepassing op alle bestellingen en overeenkomsten die via de webshop van Petit Cake Atelier tot stand komen.
These terms apply to all orders and agreements concluded through the Petit Cake Atelier webshop.
3. Totstandkoming van de overeenkomst / Formation of the agreement
Na het plaatsen van een bestelling ontvangt de klant een automatische orderbevestiging per e-mail.
Tijdens het bestellen kan de klant een gewenst afhaalmoment opgeven. Dit betreft een voorkeursmoment.
De bestelling wordt definitief ingepland nadat de klant een afzonderlijke bevestiging per e-mail heeft ontvangen met het afhaalmoment.
Petit Cake Atelier behoudt zich het recht voor een voorgesteld tijdstip te wijzigen indien dit noodzakelijk is voor de productieplanning.
After placing an order, the customer receives an automatic order confirmation by email.
During ordering, the customer may select a preferred collection time. This is a request only.
The order is scheduled after the customer receives a separate confirmation email with the collection time.
Petit Cake Atelier reserves the right to adjust the proposed time if necessary for production planning.
4. Afhalen / Collection
Bestellingen worden uitsluitend op afspraak afgehaald. Het adres betreft geen winkel en er is geen vrije inloop mogelijk.
De klant dient op het bevestigde tijdstip aanwezig te zijn. Bij te late afhaling kan een nieuw afhaalmoment worden voorgesteld.
Indien een bestelling niet wordt afgehaald, vervalt het recht op restitutie.
Orders are collection by appointment only. The address is not a retail shop and walk-ins are not possible.
The customer must arrive at the confirmed time. If the customer is late, a new collection time may be proposed.
If an order is not collected, the right to a refund expires.
5. Annulering en wijziging / Cancellation and changes
Alle producten worden op bestelling en met de hand gemaakt. Met betaling van de bestelling reserveert de klant productiecapaciteit.
Na betaling is annuleren niet mogelijk en worden betalingen niet terugbetaald.
Wijzigingen in ontwerp, datum of afhaalmoment zijn afhankelijk van beschikbaarheid en kunnen niet worden gegarandeerd.
All products are made to order and prepared by hand. Payment reserves production capacity.
After payment, cancellation is not possible and payments are non-refundable.
Changes to design, date or collection time depend on availability and cannot be guaranteed.
6. Herroepingsrecht / Right of withdrawal
De producten van Petit Cake Atelier zijn bederfelijk en worden op maat gemaakt. Daarom is het herroepingsrecht uitgesloten conform artikel 6:230p sub f BW.
The products of Petit Cake Atelier are perishable and custom-made. Therefore the statutory right of withdrawal is excluded under Article 6:230p sub f of the Dutch Civil Code.
7. Allergenen / Allergens
Producten worden bereid in een keuken waar gewerkt wordt met gluten, melk, ei, noten, pinda’s, soja en andere allergenen. Sporen van allergenen kunnen niet worden uitgesloten.
Klanten met allergieën dienen vooraf schriftelijk contact op te nemen.
Products are prepared in a kitchen where gluten, milk, egg, nuts, peanuts, soy and other allergens are handled. Traces cannot be excluded.
Customers with allergies must contact us in writing in advance.
8. Aansprakelijkheid en transport / Liability and transport
Na overdracht van het product aan de klant gaat het risico over op de klant.
De klant is verantwoordelijk voor correct transport, opslag en koeling van het product.
Schade ontstaan na afhalen, inclusief transportschade of onjuiste bewaring, valt niet onder de verantwoordelijkheid van Petit Cake Atelier.
After transfer of the product to the customer, the risk transfers to the customer.
The customer is responsible for proper transport, storage and refrigeration.
Damage occurring after collection, including transport damage or improper storage, is not the responsibility of Petit Cake Atelier.
9. Overmacht / Force majeure
In geval van overmacht, zoals ziekte, technische storing of omstandigheden buiten de redelijke invloed van Petit Cake Atelier, kan een bestelling worden geannuleerd. In dat geval wordt het volledige aankoopbedrag terugbetaald.
In case of force majeure, such as illness, technical failure or circumstances beyond reasonable control, an order may be cancelled. In such cases, the full purchase amount will be refunded.
